     Having been in real estate for over 30 years, I have seen a lot of changes in the industry as a whole.  In 1979 interest rates were hovering around  the 18% range.   During the 1980's and 1990's  I sold  tobacco farms to developers in central North Carolina and taught retiring tobacco farmers how to hold the financing on their land.  For the past 15 years, I have been a resort specialist selling beach properties in the Wilmington area for second homes and investment.  In the ever changing world of real estate, today's market trend is bank owned properties/foreclosures, my 30 years of experience and education, both as an Instructor and perpetual student,  has culminated in  my becoming an extremely effective advocate for my clients.

FORECLOSURES VS SHORT SALES

The FORECLOSURE PROCESS:  Once an owner has defaulted on the loan, the TRUSTEE under the rights of the Trustee's Deed, will advertise and hold an open auction on the Court House steps.  This serves as notice to any and all persons or entities who have liens on the property that they may bid  and purchase the home.  Usually the bank with the first mortgage lien will win the bid and they become the legal owners.  This process negates any additonal lien holders and the bank will pass it on  a free and clear Title free of any additonal liens.

 

SHORT SALES are simply a pre-foreclosure attempt to negotiate with the first mortgage lien holder for the purchase of home.  Under a Short Sale, there may be other outstanding liens that the new Buyer would be responsible for.  Keep in mind that the legal owner of  the property is still the seller, not the bank.
